Nice to meet you. We’re poppin. For those who care about these kinds of things, our full corporate name is poppin inc., and we are a Delaware corporation.

Thank you for visiting us. We understand that you are mindful of how information about you is used and shared. We’ve put together this Privacy Policy (“Policy”) to describe how we collect, use, store, process, and share your information in relation to the Site. By the way, when we use the word “Site,” it’s really shorthand for the https://Poppin.com web site, our mobile applications, and our Social Media pages that we may use to put all of our great products at your fingertips and that provide your information to us, and which we describe in more detail below.

When you visit or use the Site or place an order, you expressly consent to the collection, use, storage, processing, and disclosure of your information, including personally identifiable information, as described in this Policy. This Policy is part of and incorporated into the Terms of Use governing your use of the Site, so please be sure to review the Terms of Use prior to using the Site. If there is something in this Policy that you don’t agree with, you should not use the Site or place an order.

WHAT INFORMATION DOES POPPIN COLLECT?

We are fanatically driven to make your experience with us easier and better for you. So, wherever we can, we collect and store information that may make it easier for us to improve the shopping experience, display the product or content in which you are likely to be most interested, and make it easier for you to reorder without having to enter information you have already provided.

The information we collect is related to visiting on our Site and using the Site’s features and falls into three general categories:

  1. Information and content you provide, including when you use the Site, create an account with us, place an order, or communicate with us

  2. Information collected automatically via cookies and other technologies

  3. Information we obtain from other sources.

INFORMATION YOU PROVIDE

We collect personal information that you voluntarily provide to us when you use the Site, create an account, place an order, or communicate with us, such as:

  • your name

  • information about your company affiliation, if applicable, such as company name and your business title

  • a user name and password you may establish with us

  • your contact information, such as your e-mail address, postal address, phone number

  • payment information

  • information about the products you purchase or tell us you are interested in

  • contact information you share about others you want to invite to the Site (such as e-mail addresses)

We also collect information you provide to us pursuant to promotional programs, such as contests and information provided at tradeshows.

CONTENT YOU PROVIDE / PRODUCT REVIEWS

From time to time, you may send us mail or e-mail that gush about our products or services, videos that show how far your packing list can travel in the shape of an airplane, or other content. We will collect and store this information and may use it for promotional purposes if you have agreed to let us do that.

You may choose to submit a product review. If you post a review, we may ask for personal information such as an e-mail address to confirm you are a real person. We will not share with other Site visitors the personal information that you submit as part of the review, but you may share it if you choose to (for example, via social media). We are not responsible for any personal information that you choose to submit as part of the content of your review. We believe you can post a helpful review without disclosing personal information and allow you to create a nickname if you do not want your personal information to be displayed.

GEOGRAPHICAL LIMITATIONS

The owner of the Site is based in the State of New York in the United States. We provide the Site for use only by persons located in the United States. We make no claims that the Site or any of their content is accessible or appropriate outside of the United States. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.

INFORMATION COLLECTED BY COOKIES AND OTHER TECHNOLOGIES

When you visit the Site, we, our service providers, and other third parties may automatically collect information about you, your computer or mobile device, and activity occurring on or through the Site. These parties may collect this type of information over time and across third-party websites and may use cookies, web beacons, and other technologies to collect this information. This information may include:

  • Information about the software on your device, such as model and screen resolution

  • Unique identifiers associated with your device, such as device identifier (e.g., Google Advertising ID or Apple ID for Advertising)

  • Information about your use of and actions on the Site, such as pages you viewed, how long you spent on a page, navigation paths between pages, information about your activity on a page, links you click, access times, and length of access; and the website that referred you to the Site, if applicable

  • Information about your interaction with our e-mails, such as whether you opened our e-mail and how long you had it open

INFORMATION COLLECTED FROM OTHER SOURCES

We may receive information from other sources to help us serve you better. Examples include, but are not limited to, delivery and address correction information from our carriers, which we use during checkout to make sure your order goes to the right location.

We may also receive information about you from our service providers and business partners, including companies that assist with payment processing, analytics, advertising, marketing, data processing and management (e.g., to measure ad quality and responses to ads, and to display ads that are more likely to be relevant to you, including for Poppin products), account management, hosting, customer and technical support, content moderation, and other services which we use to personalize your experience.

HOW DOES POPPIN USE PERSONAL INFORMATION?

We use your information for the following purposes:

To provide our services. We use personal information to:

  • provide, operate and improve the Site, including to develop new products and services,

  • process and fulfill your order and otherwise provide the products and services you request,

  • communicate with you about your order and our services, including by sending you order and shipping confirmations, announcements, updates, security alerts, and support and administrative messages,

  • personalize your experience with the Site, and our communications, and

  • provide support and maintenance for the Site and our products and services, including by responding to your requests, questions and feedback. 

To send you marketing and promotional communications. We may send you Poppin-related marketing communications, offers, and advertising. We may also send you various business-to-business (B2B) communications from our affiliated entities that are related to products that you have purchased from us. You will have the ability to opt out of our marketing and promotional communications as described in the section below titled “Opt out of marketing”. Please note that, even if you opt out of receiving marketing and promotional communications, we may still send you transactional emails related to your account with us, including administrative emails, maintenance emails, operational emails (for example, in connection with a password reset request), and responses to any "contact" request you initiate.

To display advertisements. We work with advertising partners to display advertisements online. These advertisements are delivered by our advertising partners and may be targeted based on your use of the Site or your activity elsewhere online. To learn more about your choices in connection with advertisements, please see the section below titled “Targeted online advertising.”

For compliance, fraud prevention, and safety. We may use your personal information and disclose it to law enforcement, government authorities, and private parties as we believe necessary or appropriate to: (a) comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities; (b) protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims); (c) enforce the terms and conditions that govern the Site; and (d) protect, investigate and deter against fraudulent, harmful, unauthorized, unethical or illegal activity.

JOB APPLICANTS

If you apply for a job with us, we will use the information you submit to process your application and assess your capabilities and qualifications, as permitted by law. The information we collect includes business and personal contact information, professional credentials and skills, educational and work history, and other information of the type that may be included in a resume. This may also include diversity information that you voluntarily provide. We use this information to facilitate our recruitment activities and process employment applications, such as by evaluating a job candidate for an employment activity, and monitoring recruitment statistics. We may also use this information to operate and improve the website or our services, and as otherwise necessary for compliance, fraud prevention, and safety purposes.

INFORMATION POPPIN SHARES WITH OTHERS

We share personal information with affiliated entities such as to send you B2B communications and for other purposes described in this Policy, and our service providers, which provide services to us or on our behalf, such as fulfilling orders, delivering packages, sending e-mails, analyzing data, providing marketing assistance, and processing credit card payments.

We also share information when we believe its release is appropriate and necessary to comply with the law; to government regulators or law enforcement authorities in connection with any judicial proceeding, court order, subpoena or legal process served on us or the Site; to enforce or apply this Policy and the Terms of Use; or to protect the rights, property or safety of Poppin, our employees and users. We may exchange information with other companies or organizations for fraud protection and credit risk reduction.

HOW DOES POPPIN PROTECT MY INFORMATION?

We have implemented a number of security measures to protect your personal information, and we have extra layers of security around your payment information. We work to protect the security of your information during transmission by using Secure Sockets Layer (SSL) software, which encrypts information you input. In addition, your account information is protected by a password for your privacy and security. It is important that you keep your password to yourself and log off once you have finished using a shared computer so that others can’t access your account.

While we take measures to safeguard your personal information, we cannot ensure that all of your information will never be disclosed in ways not otherwise described in this Policy. For example, a third party may unlawfully intercept or access transmissions or private communications, or other users of the Site may abuse or misuse your personal information. No transmission of data over the internet can be 100% secure.

If Poppin learns of a security system’s breach, we may attempt to notify you so that you can take appropriate protective steps.

YOUR CHOICES

Access or Update Your Information

Individuals with accounts on the Site may access, remove, review, and/or make changes to certain information that was provided to us by following the instructions found on the Site.

Opt Out of Marketing Communications

You may manage your receipt of marketing and non-transactional communications by clicking on the “unsubscribe” link located on the bottom of any Poppin marketing e-mail. We may continue to send service-related and other non-marketing e-mails, such as order and shipment confirmations.

Cookies and Browser Web Storage

We may allow service providers and other third parties to use cookies and similar technologies to track your browsing activity over time and across the Site and third party websites. We allow you to adjust your cookie settings via the Cookie Banner on the Site. In case if you don’t see this banner, please clear your browsing history and data and refresh the page. Please contact us if you continue to experience any difficulties. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings. Please note that if you set your browser to disable cookies entirely, the Site may not work correctly. Similarly, your browser settings may allow you to clear your browser web storage.

Targeted Online Advertising

Some of the business partners that collect information about users’ activities on or through the Site may be members of organizations or programs that provide choices to individuals regarding the use of their browsing behavior or mobile application usage for purposes of targeted advertising.

Users may opt out of receiving targeted advertising on websites through members of the Network Advertising Initiative by clicking here or the Digital Advertising Alliance by clicking here. Please note that we also may work with companies that offer their own opt-out mechanisms and may not participate in the opt-out mechanisms that we linked above.

If you choose to opt out of targeted advertisements, you will still see advertisements online but they may not be relevant to you. Even if you do choose to opt out, not all companies that serve online behavioral advertising are included in this list, so you may still receive some cookies and tailored advertisements from companies that are not listed.

Do Not Track

SPECIAL NOTICES

This Site Is Not for or Directed Towards Children

Our primary audience is adults. While the Site is not for anyone under the age of 18, we certainly do not intend to and will not knowingly collect any personal information from children under the age of 13. If we learn that we have collected information from a child under the age of 13, we will remove that information and delete it from our servers (subject to applicable law and this Policy). Sales of Personal Information

The California Consumer Privacy Act (CCPA) requires companies like ours to disclose the personal information we have “sold” over the last year. The CCPA defines “sale,” among others, as making available consumer’s personal information to others for monetary or other valuable consideration. This includes but is not limited to targeted marketing.

Exercising Your California Privacy Rights

The CCPA grants California residents the following rights:

  • Right to Information: You have the right to request information about how we have collected, used, and shared your personal information during the past 12 months. You also have the right to disclosure of the specific pieces of personal information collected by us.

  • Right to Access: You have the right to receive a copy of the personal information that we maintain about you.

  • Right to Delete: You have the right to request that we delete personal information we have collected from you (and direct our service providers to do the same). In some instances, however, we may decline to honor your request where an Exception applies.

  • Right to Opt Out of the “sale” of personal information: You have the right to request to opt-out of any future “sale” of personal information about you.

  • You also have the right not to be discriminated against for exercising any of the rights listed above. 

Please note that the CCPA limits these rights by, for example, prohibiting us from providing certain sensitive information in response to an access request and limiting the circumstances in which we must comply with a deletion request. If we deny your request, we will communicate our decision to you.

We will deliver personal information that we are required by law to disclose to you in the manner required by law within 45 days after receipt of a verifiable request, unless we notify you that we require additional time to respond, in which case we will respond within such additional period of time required by law. We may deliver the personal information to you through your account, if you maintain an account with us, or electronically or by mail, whatever you prefer. If you ask us to send it electronically, we will deliver the information in a portable and, to the extent technically feasible, in a readily usable format.

Please note that we may take steps to verify your identity before granting you access to information or acting on your request to exercise your rights, as required or permitted by law. We may limit our response to your exercise of the above rights as permitted by law.

California residents can empower an “authorized agent” to submit requests on their behalf. We will require the authorized agent to have a written authorization confirming that authority.

Exceptions

We may deny your deletion request if retaining the information is necessary for us or our provider(s):

  • to complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you,

  • to detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities,

  • to debug products to identify and repair errors that impair existing intended functionality,

  • to exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law,

  • to comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.),

  • to engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent,

  • to enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us,

  • to comply with a legal obligation, or

  • to make other internal and lawful uses of that information that are compatible with the context in which you provided it (each an “Exception” and collectively, “Exceptions”).

Data Sharing for Direct Marketing Purposes

California Civil Code § 1798.83 further permits California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. If you are a California resident, you may ask us to refrain from sharing your personal information with certain of our affiliates and other third parties for their marketing purposes. MERGERS, ACQUISITIONS & INSOLVENCY

We expect to be around for the long haul. With that said, if Poppin should ever file for bankruptcy or engage in a business transition such as a merger with another company, or if Poppin decides to buy, sell or reorganize some part or all of its business, Poppin may disclose your personal information, including to prospective or actual purchasers in connection with one of these transactions.

NOTE TO INTERNATIONAL USERS

The Site and our products are not currently being offered outside the United States. Any information provided to us by you will be transferred to the United States and by using our Site or ordering products you consent to the transfer and use of your information, including personally identifiable information, in accordance with this Policy. It is important to note that the privacy laws in the United States may not be as comprehensive as those in other countries such as the European Union. We require that our service providers use appropriate safeguards when transferring your personal data from Europe to the United States.

UPDATES TO THIS POLICY

While we really like the way things are working right now, it is inevitable that we will change some things over time, as we learn more about you and how we can best serve you. We reserve the right to modify this Policy at any time. If we modify it, we will post the new version right here, so it is important that you check back on a regular basis to see whether we’ve made any changes, as you will be agreeing to the new Policy by using the Site after the new version has been posted.
